Creative Commons

Cuando Lawrence Lessig creó en 2001 Creative Commons, muy pocos podían imaginar siquiera la posibilidad de flexibilizar los derechos de autor, pero sin embargo, la necesidad estaba presente. Con el fin de promover tipos de licencia de autor que tienen una forma más flexible y razonable, e intentar reducir las barreras legales de la creatividad, este proyecto se ha convertido en uno de los estandartes de la difusión del conocimiento de forma libre, así como del software libre (de donde también se inspiraron, mediante las licencias GPL o General Public License), que no es más que un caso particular de lo anterior.

Sin duda, desde la licencia más permisiva (únicamente el reconocimiento del autor de la obra) hasta la más restrictiva (reconocimiento sin posibilidad e modificación ni fines comerciales), toda persona que haya creado algo, puede encontrar con Creative Commons la forma de difundirlo libremente, sin perder por ello el reconocimiento.
Actualmente, el reto más importante de este proyecto se centra en adaptar las diferentes alternativas de licencias a la legislación de cada país, y traducirlas al mayor número de idiomas posible, para la comprensión de todo usuario potencial. Este proceso lo lleva a cabo el proyecto Creative Commons International.

De esta forma, más que una alternativa al Copyright, nos encontramos con un sustituto en potencia, que amplía la gama y las posibilidades de proteger los derechos de autor. En mi opinión, gracias a Creative Commons, veremos un aumento de la creatividad y la difusión del conocimiento, que en parte paliará los efectos comentados en entradas anteriores y que espero que relegue a un segundo plano al Copyright.

Retomando en cierto modo la lectura de Richard Stallman, resulta sorprendente hasta donde pueden llegar ciertas organizaciones con el fin de recaudar e impedir la evolución del conocimiento, aunque seguro que éstas no lo creen así. Me parece increíble el trato criminal que se les da a las personas que intentan difundir conocimiento, como la sentencia penal al programador que difundió fallos en la tecnología de los libros electrónicos, nada menos que en un congreso, fallos de los cuáles las empresas y los editores de libros electrónicos pueden aprender, ya que si un programador lo ha descubierto, no tardarán en descubrirlo otros, y esa vez no se hará público, visto el resultado de tal acción, por lo que en vez de admitir esos fallos tecnológicos y subsanarlos, los seguirán teniendo y será posible que los usuarios los vulneren. Frenando así la difusión del conocimiento y además están incurriendo en graves ineficiencias. Otro ejemplo son las acciones legales contra las redes P2P, una forma rapidísima de difundir tanto conocimientos nuevos, como conocimientos antiguos que sólo unos pocos privilegiados poseen.

Todas estas acciones llevadas a cabo por este tipo de organizaciones me parecen un lastre para la sociedad, y la evolución y progreso de la humanidad. Penalizando la difusión de conocimiento y creatividad se desincentiva en gran medida la investigación y, por lo tanto, se ralentiza la evolución de los conocimientos. De seguir así, después de un siglo tan brillante como el anterior, nos veremos en cierta medida estancados, y en mi opinión no es por aquello de “ya está todo inventado” si no por lo palos en las ruedas que se ponen a la creatividad y libertad del conocimiento.

“Contenido y continente, creación y distribución” – Ismael Peña

Con la finalidad de aclarar ciertos conceptos relacionados con los derechos de autor y el software libre, en esta lectura se nos explica la diferenciación clara y necesaria que existe (o debería existir) entre distribuidor y creador, en cuanto al contenido y al continente. En opinión del autor, con la que también estoy de acuerdo, se debe potenciar y proteger a los creadores de contenido en lugar de volcarse tanto en los distribuidores, como se hace actualmente en muchas áreas. De esta forma, se le debe dar un mayor protagonismo al creador, así como una cierta remuneración que debería aportar el consumidor final del contenido, y que en la actualidad obtienen los distribuidores, que pasarían a aportar valor añadido al producto final, en vez de ser meros trasmisores de obras de los creadores a los consumidores.

En cuanto al continente, se expone la posibilidad, muy acertada, de que el autor se autoedite y tenga la alternativa de distribuirse por sí mismo, (por ejemplo, a través de licencias creative commons) mientras que la distribución del continente debería desaparecer finalmente, ya que no aporta nada en realidad.

Mientras estaba leyendo el artículo de Richard Stallman, pensaba que se trataba de una novela más, con ciertas similitudes con un futuro cercano al que podríamos enfrentarnos de seguir con el mismo camino que lleva la sociedad actual. Sin embargo, al avanzar en la lectura, me dí cuenta de mi gran equivocación. El creador e impulsor del software libre plantea una serie de paralelismos entre los problemas ficticios de su artículo y los problemas reales, y la verdad es que me parecen escalofriantes. Algo tan irreal como parecía la organización SPA y todo el poder que tenía sobre los ciudadanos y, en cierto modo, sobre los gobiernos también, resulta que existe, y que la BSA, y también las grandes corporaciones, están ganando cada vez más terreno en la sociedad y en los gobiernos occidentales.

Pero, ¿cuándo debería decir un gobierno hasta aquí hemos llegado a una empresa que tiene 100.000 empleados y que aporta una gran cantidad de ingresos y riqueza al Estado? ¿Cuál sería el coste para el gobierno de turno de tomar las medidas necesarias contra grandes empresas e instituciones que toman este tipo de medidas tan restrictivas respecto a los derechos de autor?

En mi opinión, hay un cierto temor gubernamental a regular y legislar en estos campos debido a estas empresas e instituciones, y al elevado coste que esto les puede suponer, tanto monetario como electoral. Pero si se continúa con esta pasividad y este tipo de medidas siguen aplicándose y endureciéndose, dentro de pocos años el temor de los gobiernos seguramente les llegue por parte de la sociedad, y las demandas que efectúe esta para cambiar la legislación, y hacer que el conocimiento sea realmente libre, creativo y en constante evolución y no algo del pasado, caduco, y por lo que todos tenemos que pagar.

Cybertecture: The Egg, Mumbai (India)

Going on with the same topic as the last post, but this time moving farther away, I came across some very interesting information about this project. The Cybertecture Egg is the latest design of James Law, the egg-shaped high-tech building will be the iconic architecture, environmental design, intelligent systems, and an awe-inspiring landmark in Mumbai.

This city is said to be the most populated in the world, according to several estimations, taking into account that a lot of Mumbai´s citizens are under the poverty threshold and are not even in the official census. Although the image that western countries´ inhabitants may have of India has nothing to do with richness and technology, Indian tech-students are probably the best qualified in the world, and according to Forbes´s last list of billionaires, 4th and 5th places of the ranking are hold by Indians. Mumbai is also home of the Indian biggest stock exchange, which is also one of the biggest and most important in Asia.

Projects like this one are what the city needs to change its image to the rest of the world. The 32,000 squared metres egg-shaped build will accommodate 13 floors of offices. The concept was inspired, according to the designers, by considering the world as an ecosystem allowing life to evolve. Elements of the design and intelligent systems will work together to give the building’s inhabitants the ‘best space to work in’. This includes monitoring their health. Within the building, there will be a series of innovative systems such as ‘cybertecture health’ in the washroom which is designed to keep track of the inhabitant’s health including blood pressure and weight. The data collected may be retrieved and sent to a doctor if deemed necessary.

The building incorporates passive solar design to decrease heat gain and lower energy loads. An elevated garden also moderates temperature by using natural vegetation to assist with cooling the building envelope. The Cybertecture Egg will use solar photovoltaic panels and rooftop wind turbines to generate onsite electricity. Water conservation will be managed with a grey water recycling system that will harvest water for irrigation and landscaping.

It is also said that we can see this futuristic “Cybertecture Egg” building by the end of 2010. We are going to have to wait and let´s see if this is finally constructed, but for now, here are some of the pictures of the project:

The Deathstar

Yet again in Dubai, another wacky proposal, this time is called the Deathstar (yes, like in Star Wars, though now, in modern times, it´s an Eco Deathstar). This has been a project for some years now, and the fact is that there is a technopark being built in Dubai, where is also supposed that this building will be constructed. But it´s still a project.

Anyway, here´s what we may see in the future if this becomes real:

This project is also known as the Technosphere, and is said that it´s not, apparently, based on Star Wars’ infamous Deathstar, but instead on a Japanese Panasonic radio from the early 1970s.

It replicates the Earth as a structural concept. Inside the eco-sphere is an entire world which serves as a vehicle to explore the issues of self-sustaining life on a smaller level. The Technosphere is meant to reflect the state of our planet in current and future times. Proposed as an iconic building for the Technopark of Dubai, the eco-sphere would be a carbon neutral tourist attraction as well as a place in which to live and work.

The Technosphere is a mixed-use building providing office and residential space as well as a hotel and public courtyards. This living, breathing building operates in a similar fashion to the Earth itself, providing energy, recycling water, and providing sustenance to its occupants. The exterior forms a shell around the interior spaces and will house solar panels for electricity generation. Inside, sky gardens act to shield the interior spaces from the sun and filter the air to contribute fresh oxygen to the indoor environment. Water will be recycled and efficiently used.

The project was designed by the architect James Law, known for his work in `cybertecture´, which is a combination of advanced technologies, architecture, and multimedia experiences for users. This new design, the Technosphere, was presented at the UltraFuture Conference in 2008, during which the Future of the Built Environment was explored.

Who knows if this will ever be built, but seeeing all this craziness with mega building projects, sooner or later a building similar to this will become true.

Pivoting skyscrapers

What´s the deal with pivoting skyscrapers? Are they going to be new icons in every major city? For now, they are expected to be a reality in Dubai and Moscow by 2010, but delays are expected. The works began back in 2008, and just a few people knew about the project then. Now, they are becoming more popular and more investors get interested in these skyscrapers.

I think that the Dubai and Moscow towers will be only the beginning, if the idea works well, we will probably see pivoting skyscrapers in most big cities around the world. They are expensive to build, but if they are sold well, the return of investment is certainly worth it, and so is the tourism and millionaires coming to the city where the skyscraper is placed.

For a further explanation of these new kind of buildings, here´s a document taken from scribd, which most likely will clarify some common doubts. A staggering fact that I found out with this document was that each inhabitant will park his/her park by his/her appartment.
